Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the GOdigtl AI Visibility Audit dashboard at https://audit.godigtl.com and the marketing site at https://godigtl.com (together, the “Service”), provided by The Gordo Group, Inc., a Georgia corporation doing business as GO Digital (“GO Digital,” “GO Digtl,” “we,” “us,” or “our”).
By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
GO Digital provides a dashboard that shows businesses how visible they are across AI assistants (such as ChatGPT, Claude, Gemini, and Perplexity) and provides recommendations to improve that visibility. Certain features let you connect your own Google account (Search Console and/or Google Analytics) so we can pull read-only data to inform your recommendations, as described in our Privacy Policy.
2. Accounts
- You must provide accurate information when creating an account and keep your login credentials confidential.
- You are responsible for all activity that occurs under your account.
- You must notify us promptly at support@godigtl.com if you suspect unauthorized use of your account.
- You must be at least 18 years old to use the Service.
3. Connecting Your Google Account
- Connecting Google Search Console and/or Google Analytics is optional and entirely within your control. You may disconnect at any time from your dashboard or by revoking access at https://myaccount.google.com/permissions.
- You represent that you have the right to connect the Google account and properties you provide (e.g., you are an owner or authorized user of the Search Console property and GA4 property).
- We access this data on a read-only basis solely to provide the Service to you, as described in our Privacy Policy.
4. Third-Party Services and Integrations
The Service integrates with, relies on, and/or queries a number of third-party services to function, including Google (Search Console and Analytics), Stripe (payments), Railway (hosting), Resend (email), FireCrawl (website content analysis), WordPress.com (optional publishing of approved content recommendations to your connected site), and AI platforms including Anthropic (Claude), OpenAI (ChatGPT), Perplexity, and Google (Gemini), which we query via their official APIs to analyze how your business appears in AI-generated responses.
- No control over third parties. We do not own, operate, or control these third-party services. We are not responsible for their availability, accuracy, performance, security, or content, and we do not guarantee that any of them will remain available, unchanged, or compatible with the Service.
- Changes outside our control. Any of these third parties may change, restrict, rate-limit, or discontinue their APIs, terms, or pricing at any time, which may affect the Service’s functionality. To the extent permitted by law, we are not liable for any resulting interruption, degradation, delay, or loss of functionality, data, or results.
- Their terms apply too. Where you connect or interact with a third-party service through the Service (for example, connecting your Google account), your use of that third-party service is also governed by that provider’s own terms of service and privacy policy, which you are responsible for reviewing and complying with.
- No liability for third-party acts. To the maximum extent permitted by law, we disclaim liability arising from your or our use of, or reliance on, any third-party service — including inaccurate or incomplete data returned by a third party, outages, security incidents at a third party, or termination of our or your access by that third party.
5. Subscriptions and Payment
The Service is offered in tiers, including a one-time STRATEGY report and monthly TECH and RESULTS subscriptions. The current price for each tier is shown at checkout and on our website. Subscriptions are billed in advance through our payment processor, Stripe, and renew automatically each month at the then-current price for your tier until you cancel.
- Auto-renewal. By starting a subscription, you authorize us, through Stripe, to charge your payment method the recurring fee at the beginning of each billing period until you cancel. We will charge the then-current price for your tier.
- Cancellation. You may cancel at any time from your dashboard (Billing & Subscription → Cancel). Cancellation takes effect at the end of your current billing period: you keep access until then, you will not be charged again, and fees already paid are non-refundable.
- Failed payments. If a charge fails, we may suspend or limit your access until payment is resolved.
- Price changes. We may change subscription prices; we will give you advance notice, and any change applies to your next billing period after the notice.
- Your data after cancellation or closure. What happens to your data after your subscription ends or you close your account is described in our Privacy Policy (Section 2.3).
If you are a California resident, you may cancel your subscription as described above at any time, and cancellation will stop all future charges.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Attempt to gain unauthorized access to the Service, other accounts, or our systems;
- Interfere with or disrupt the integrity or performance of the Service;
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law;
- Use the Service to connect a Google account you are not authorized to access;
- Resell, sublicense, or provide the Service to third parties without our written consent.
7. Intellectual Property
The Service, including its software, design, and content (excluding your own data and any data retrieved from your connected Google account), is owned by The Gordo Group, Inc. and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during your subscription term.
8. Your Data
You retain ownership of the data you provide and the data retrieved from your connected Google account. You grant us a limited license to use that data solely to provide and improve the Service to you, consistent with our Privacy Policy.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY RECOMMENDATIONS WILL IMPROVE YOUR VISIBILITY IN ANY AI ASSISTANT OR SEARCH PLATFORM.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE GORDO GROUP, INC. AND ITS OWNER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) US $100.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law — including liability for fraud or fraudulent misrepresentation, gross negligence, willful misconduct, or, where you are a consumer, death or personal injury caused by our negligence and any statutory consumer rights that cannot be waived. Because some jurisdictions do not allow certain limitations or exclusions of liability, some of the limitations above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless The Gordo Group, Inc. and its owner from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Service, or your connection of a Google account you were not authorized to connect. This does not apply to the extent a claim arises from our own gross negligence or willful misconduct, or where such indemnification is not permitted by law.
12. Termination
We may suspend or terminate your access to the Service if you materially violate these Terms. You may cancel your subscription or close your account at any time from your dashboard or by contacting support@godigtl.com. See our Privacy Policy for what happens to your data, including Google connection data, after cancellation or closure.
13. Changes to the Service or Terms
We may modify the Service or these Terms from time to time. We will post updated Terms at this URL with a new “Last updated” date, and for material changes we will provide reasonable advance notice (for example, by email or an in-product notice) before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws principles. This choice of law does not deprive you of the protection of any mandatory consumer-protection laws of the country in which you reside.
15. Dispute Resolution
Before filing any claim, you agree to first contact us at support@godigtl.com and attempt to resolve the dispute informally for at least 30 days. Any dispute not resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Georgia, USA, and you consent to personal jurisdiction there — except that either party may seek injunctive relief in any court of competent jurisdiction, and, where you are a consumer, nothing here deprives you of the right to bring proceedings in the courts of your country of residence where required by applicable law.
